Linking of Aadhaar, Bank account must

The government has proposed extending the deadline for mandatory Linking of Aadhaar, Bank account must and cellular phones from December 31, 2017, to March 31, 2018, but just for people who are “willing to enroll for Aadhaar card status.”

The proposal was contained in a one-page note which has been passed on to a Bench led by Chief Justice of India Dipak Misra on Wednesday. The notice, however, insisted that those who already have Aadhaar will be “required” to sync their amounts using SIM cards, bank account, PAN and “other Aadhaar Card Strategies where Section 7 (Aadhaar Act) alarms have been issued.”

The authorities proposal created such a furor in the courtroom that Chief Justice of India Dipak Misra had to request the authorities to re-think its proposition and also make linking voluntary for Aadhaar card holders.

The court asked Attorney General K.K. Venugopal, for the Centre, if it could give an assurance that no “coercive action” would be taken against those people who don’t want to link their bank accounts and cellular phones with Aadhaar.

“Can we say you [the government] will require no coercive action until March 31?” Chief Justice Misra requested Mr. Venugopal.
Verbal assurance

Mr. Venugopal gave a verbal certainty, but this didn’t satisfy the petitioners who were challenging the constitutionality of this Aadhaar card scheme. Senior advocate Shyam Divan, for one of the petitioners, also urge Vipin Nair pointed out that the government had made several similar assurances from the Supreme Court since 2014, but Aadhaar had lasted to “spread.”

Mr. Divan reported the government’s attitude discriminated among those willing to enroll for Aadhaar, others without Aadhar card download, and ultimately, a sizeable section of the population who’ve Aadhaar but are apprehensive about connecting their bank account and cellular phones to it.

“The manner Aadhar card apply online is spreading is unconstitutional. Now those who’ve Aadhaar are vulnerable. There were reports of accounts after linking with Aadhaar, being wiped out. Individuals that have Aadhaar do not wish to link. They have to discuss their one-time password…,” Mr. Divan said.

He submitted that the petitions challenging to Generate your Aadhaar number were “crying for a hearing” at the Supreme Court because 2014.
“Please hear it in November. The Attorney General had consented to be all set for the hearing in November,” Mr. Divan explained.
